The certiorari approved by the Supreme Court allows the former attorney of ‘Sandy’, the leading figure in the Makarios Drousiotis claims to file a petition requesting the revocation of a warrant to search his home and premises, conducted last month in connection with the case.
Presiding judge Elena Ephraim ruled the claimant’s certiorari appeal as justified for a number of reasons, but rejected the appellant’s request to prevent authorities from possessing and utilising evidence acquired during the search for its ongoing investigation.
The Court found that the evidence was indeed connected with the premises search but did agree with Nicos Clerides that there was no adequate testimony to connect him with the offences in question.
She further ruled that establishing the alleged connection of the appellant with the offences was the decisive factor that led to the issuing of the initial search warrant.
‘The reasons on which police based its warrant request were generalised and vague’, the Court said, also noting the possibility of attorney-client privilege violations.
The certiorari to revoke the search warrant must be submitted over the next few days and the Attorney General notified.
