Man sues doctor over alleged wrong knee surgery

A young man in Cyprus is suing a doctor and a private hospital after allegedly undergoing surgery on the wrong knee, according to court documents.

The plaintiff claims he sought medical attention for pain in his right knee, intending to join the Special Forces. However, he alleges that he emerged from surgery with his left knee operated on instead.

The lawsuit states the doctor initially recommended surgery for a torn inner meniscus in the right knee following an MRI. The patient consented to this procedure but claims the operation was performed on his left knee without his permission.

According to the legal filing, when the patient protested, the doctor allegedly admitted the mistake and urged a second operation on the correct knee. The patient refused, seeking a second opinion from another specialist who reportedly deemed surgery unnecessary for the right knee.

The plaintiff’s lawyers argue this incident violates fundamental rights protected by the Cypriot Constitution and the European Convention on Human Rights.

In his defence, the doctor maintains that the left knee surgery was necessary, addressing issues including chondral damage and a torn outer meniscus. He contends the patient suffered no harm from the procedure.

The hospital involved asserts that the doctor is self-employed and uses its facilities as a partner.
